CONSTITUTION OF
CENTRAL COAST DISTRICT BOWLING ASSOCATION ZONE 15 INC.
1. NAME
The name of the Association shall be CENTRAL COAST DISTRICT BOWLING ASSOCIATION ZONE 15 INC.
2. INTERPRETATION
In this Constitution;
(a) BA means Bowls Australia Inc.
(b) ASSOCIATION means the Central Coast District Bowling Association Zone 15 Inc.
(c) ASSOCIATION MATCH means any match arranged by the Association.
(d) DELEGATE means a representative of an affiliated or provisionally affiliated Club as set forth in this Constitution.
(e) EXECUTIVE means the Executive Committee as defined in this Constitution.
(f)
MANAGEMENT COMMITTEE means the Executive Committee and Delegates of
affiliated and provisionally affiliated Club, plus one (1)
representative from each sub-committee.
(g) RNSWBA means the Royal New South Wales Bowling Association Inc.
(h) ZONE REPRESENTATIVE means the State Councillor to the Board of the RNSWBA.
(i)
FULL MEMBER means any MALE MEMBER of an Affiliated Club who is a
financial member of that Club having paid full subscription for
membership and having been registered with this Association.
(j) In this Constitution words in singular includes plural and vice-versa.
3. CONSTITUTION
This
CONSTITUTION shall be read in conjunction with the Constitution of the
RNSWBA and BA and the members of this Association shall be bound by the
provisions of those Constitutions as well as this Constitution.
4. COMPOSITION
The Association shall consist of affiliated and provisionally Affiliated Clubs.
5. OBJECTS
The objects of the Association shall be;
(a) To promote, advance and control the game of bowls in the area covered by the Association.
(b) To promote, arrange, manage and control Inter-Association, Intra-Association and other Association competitions and games.
(c) To receive and expend the funds of the Association.
6. MANAGEMENT
(a)
The Management Committee shall be comprised of the Executive Committee
and two (2) Delegates from each affiliated or provisionally affiliated
Club, plus one (1) representative from each sub-committee, provided
that no Club shall have more than four (4) representatives in all.
(b)
The Executive Committee shall be the President, the Secretary, the
Treasurer, the Senior Vice President, four (4) Vice Presidents and the
Zone Representative.
(c) All members of the Executive Committee
shall be elected at the Annual General Meeting of the Association and
shall hold office until their successors have been elected, with the
exception of the Zone Representative who shall be elected at the July
meeting of the Association.
(d) The Executive Committee shall
deal with all matters of urgency relating to finance and in cases of
urgency, have power to incur liability whenever necessary.
(e)
The Executive Committee shall deal with any other matters which in its
opinion should be dealt with without waiting for the ordinary or
special meeting of the Management Committee to be called, provided that
each meeting of the Management Committee, the Secretary shall report to
the Management Committee any business that shall have been transacted
or dealt with since the previous meeting.
(f) A registered
Auditor and an Honorary Solicitor shall be appointed at the Annual
General Meeting on the recommendation of the Executive Committee.
7. MEETINGS
(a) The Management Committee shall meet at such date, time and place as may be fixed by the Management Committee.
(b)
A Special General Meeting of the Management Committee shall be called
by the Secretary when directed by a resolution of the Management
Committee or the Executive Committee or on a written request from any
two (2) affiliated Clubs or from eighteen (18) Delegates and notice of
the meeting, together with business to be transacted thereat, shall be
forwarded to each affiliated or provisionally affiliated Club at least
twenty one (21) days before such meeting.
(c) The Annual Meeting of the Association shall be held on the third Thursday in the month of August each year.
(d) The Annual Meeting and Special General Meetings shall be attended by the members of the Management Committee.
(e)
No member of the Management Committee shall be permitted to attend any
meeting of the Association unless the annual subscriptions payable by
his club or any other financial commitment has been paid or an
attendance card has been issued in accordance with the provisions of
this Constitution.
(f) Should any Delegate be unable to attend
any meeting of the Association, his Club may appoint another member of
such Club to attend in his place and vote thereat.
(g) A
preliminary notice of the Annual Meeting shall be issued by the
Secretary during the first week in July in each year, setting forth the
usual business and the fact that nominations for the office of
President, Vice Presidents, Secretary, Treasurer and members of the
Permanent Sub Committees close with the Association Secretary twenty
one (21) days prior to the date of the Annual Meeting. A further
notice shall be given to all members of the Executive Committee and
Clubs at least fourteen (14) days prior to the meeting, setting out
special business and notices of motion.
8. QUORUM AT MEETINGS
(a) At all meetings of the Executive Committee, five (5) members shall form a quorum.
(b) At all meetings of the Management Committee, ten (10) members shall form a quorum.
(c)
Should a quorum not be present within thirty minutes of the starting
time of any meeting, the meeting shall lapse or may be adjourned to
such date, time and place as may be determined by those present. Such
date and time and place of the adjourned meeting shall be given by the
Secretary of the Clubs absent from the original meeting at least seven
(7) days prior to the date fixed for the adjourned meeting.
9. BUSINESS AT ANNUAL MEETING
At the Annual General Meeting of the Association, the order of business shall be;
(a) Attendance – each Club Delegate shall be required to present an admittance card.
(b)
Reading and confirmation of the minutes of the last Annual Meeting and
any Special Meetings held since the last Annual General Meeting.
(c) Consideration of the Annual Reports, Statement of Income and Expenditure and Auditor’s Report.
(d) Determine Honoraria.
(e)
Election by Ballot, if necessary for the position of President,
Secretary, Treasurer, Senior Vice President, four (4) Vice Presidents
and members of each Sub Committee.
(f) Publicity Officer shall be appointed by recommendation by the Executive.
(g) Umpires panel representative shall be nominated by the Umpires Committee and notified at the Annual General Meeting.
(h) Coaching Committee representative shall be nominated by the Coaching Committee and notified at the Annual General Meeting.
(i) Junior representative (Male) shall be nominated by the Junior Committee and notified at the Annual General Meeting.
(j)
All elections shall be by secret ballot and subject to Rule 14 (c).
Where two or more nominations from the one Club occur for a Sub
Committee, a ballot by Management Committee shall decide the nominee.
(k)
Business of which due notice is given. The notice required shall be in
writing and be in the hands of the Association Secretary at least
twenty one (21) days prior to the Annual General meeting.
10. NOMINATIONS
(a) (i) Nominations for the office of President, Secretary, Treasurer, Senior
Vice President and four (4) Vice Presidents shall be in writing on the
Association’s Nomination Forms, signed by the proposer, seconder and
the nominee, all of whom shall be full members of an affiliated Club.
(ii)
Nominations for the office of Zone Representative shall be in the hands
of the Association Secretary by the third Thursday in the month of June
and all Clubs shall be notified of nominations within fourteen (14)
days, then he shall be elected at the July meeting of the Association
and who shall hold office from the conclusion of the Annual General
Meeting of the RNSWBA until the conclusion of the next subsequent
Annual General Meeting of the RNSWBA. He shall be a permanent resident
within the boundaries of the Association.
(iii) Chairman and
Members of Permanent Sub Committees shall be full members of an
Affiliated Club who shall nominate in writing on the Association’s
nomination form signed by the proposer, seconder and nominee, all of
whom shall be full members of an affiliated Club.
All
nominations shall be in the hands of the Association Secretary twenty
one (21) days prior to the date of the Annual General Meeting. Should
nominations fall short of the number required, those nominated shall be
declared elected.
Any vacancies shall be filled at the Annual
General Meeting from the members present by nominations by a proposer
and seconder and consented to by the nominee. In the event of an
excess number of nominations a secret ballot shall be held to fill the
vacancies.
(b)(i) No person shall hold more than one position on the Executive.
(ii) No person shall be on more than one Sub Committee in any year.
(c) The Secretary of the Association shall issue a notice of the Annual
Meeting and the names of the persons nominated for office on the
Executive Committee and Sub Committee at least fourteen (14) days
before the date of the Annual Meeting together with any notice of
special business.
(d) The Delegate of the RNSWBA shall be the
President or his nominee. The Delegate will hold office from the date
of the Annual General Meeting of the Association for the ensuing twelve
(12) months.
11. CASTING VOTE OF THE PRESIDENT
At
all meetings of the Association the Chairman shall have a casting vote
as well as a deliberate vote in all matters other than in the case of a
secret ballot when the Chairman will have a deliberate vote only.
12. NOTICE OF MOTION
(a)
A Notice of Motion shall be in the hands of the Association Secretary
at least twenty one (21) days before the date of any Ordinary or
Special Meeting. The Association Secretary shall inform all members of
the Executive Committee, affiliated and provisionally affiliated Clubs
of such Notice of Motion at least fourteen (14) days prior to the date
of such Meeting.
(b) In the absence of the intending mover of
such Notice of Motion it may be moved by any member of the Management
Committee then present.
13. PATRONS (LIMIT OF TWO)
The
office of Patrons of the Association shall be filled by appointment by
the Management Committee, on the recommendation of the Executive.
14. VOTING
(a)
The voting on any motion or amendment at any meeting of the Association
shall be by a show of hands unless a secret ballot is requested.
(b) The election of Members of the Executive Committee shall be by secret ballot, individual votes being declared.
(c) Should there by an equal number of votes for the last vacancy a separate ballot shall be held on those persons only.
15. QUALIFICATION FOR AFFILIATION
(a)
Every Club of which at least sixteen (16) members shall have paid the
annual subscription for the then current year shall be entitled to
apply for affiliation with the Association and if admitted shall be
given representation on the Management Committee in accordance with
this Constitution.
(b) Every provisional Club of which at least
sixteen (16) members shall have paid the annual subscription for the
then current year shall be entitled to apply for provisional
affiliation with the Association. A condition of such provisional
affiliation shall be that a green of at least four rinks is prepared in
accordance with the Laws of the Game of Bowls and ready for play within
18 months of the date of application for provisional affiliation.
(c)
Every Club applying for affiliation or provisional affiliation shall
forward with such application a copy of its Constitution and/or a copy
of Memorandum of Articles of Association.
16. ANNUAL SUBSCRIPTIONS
(a)
Every affiliated and provisionally affiliated Club shall pay to the
Association an annual affiliation fee together with an annual
capitation fee for each of its full members, multiple members, junior
members and life members.
(b) The amount of such affiliation fee and capitation fee shall be fixed at the March meeting each year.
(c) Such fees shall be paid to the Association Secretary before the 31st day of July in each year or no later than 30 days after end Affiliated Club's financial year.
(d)
The Secretary or Hon. Secretary of every affiliated and provisionally
affiliated Club shall pay to the Association Secretary the capitation
fee of any such additional Full Member, Multiple Member, Junior Member
accepted for membership of his club after 31st July each year. Such
fees to be paid no later than thirty (30) days after membership of the
Club had been granted.
(e) The membership listing sent by the
RNSWBA to all affiliated and provisionally affiliated Clubs for the end
of their financial year, as well as to the Association Secretary, will
be updated by the Clubs using the RNSWBA membership and change forms,
forwarding a copy to the Association Secretary no later than when the
annual fees payable to the RNSWBA are paid. That membership list
together with any additional Full Members, Multiple Members and Junior
Members notified to the Association during the year, provided that
annual subscriptions have been paid, shall be eligible to compete in
all Club and Association competitions during that year.
(f) The
payment by a Club of its annual affiliation and capitations fees will
entitle its Delegates to attend, speak and vote at any meeting of the
Management Committee or any Special Meeting up to and including the
31st July next following.
17. ALTERATION OF THE CONSTITUTION AND RESCISSION OF RESOLUTIONS
(a)
A provision of this Constitution may not be amended or repealed and a
new provision may not be added except by a resolution that is effective
for the purposes of this clause.
(b) A resolution is effective for the purposes of this clause if, and only if;
(i)a draft of the amendment or addition has been delivered to the
Secretary of the Association at least twenty one (21) days before the
making of the amendment or addition and the Secretary shall deliver to
the C.E.O. of the Association a draft copy of all amendments or
additions within fourteen (14) days.
(ii) a notice has not been
given by the Chief Executive Officer of the RNSWBA before the amendment
or addition is made informing the RNSWBA that the amendment or addition
has been disallowed by the RNSWBA on the ground that it would be
inconsistent with any provision of the RNSWBA’s Constitution.
(iii)
the resolution is passed, at a Special General Meeting of the
Association of which not less than twenty one (21) days notice has been
served on all Affiliated Clubs and Committee members, by the majority
consisting of at least three-quarters of the persons present and voting
at the meeting.
18. ROYAL NEW SOUTH WALES BOWLING ASSOCIATION INC.
(a)
The Association may affiliate with the Royal New South Wales Bowling
Association Inc. and may withdraw therefrom upon a resolution of the
Management Committee carried by a majority of two-thirds of the
Delegates present and voting.
(b) At least twenty eight (28)
days notice by circular must be given to the Secretary to all
affiliated and provisionally affiliated Clubs of any proposal to
withdraw.
19. SOCIAL BOWLING CLUBS
(a)
The Association may grant recognition to Social Bowling Clubs formed by
full or Life Members of affiliated or provisionally affiliated Clubs
joining together through a common interest.
(b) Social Bowling
Clubs shall be required to send to the Association each year in the
month of August a full list of their offices and members together with
address and the name of the club of which they are full or life members.
(c)
Recognised Social Bowling Clubs shall be required to pay an Affiliation
fee of $30.00 to the Association, before 31st day of July in each year.
20. LEVIES ON AFFILIATED CLUBS
The
Association may by a resolution passed in General Meeting by a majority
of two-thirds of the persons present and voting at that meeting, impose
on all affiliated Clubs a levy of an amount determined or calculated in
the manner specified in the resolution imposing the levy payable by
each affiliated Club within such period as may be so specified.
21. GREENS OF AFFILIATED CLUBS
(a)
The Association from time to time may require any affiliated Club to
make available its greens, or such part of its green, as the
Association determines, for the playing of lawn bowls in any
Association event or any competition under the control of the
Association.
(b) If an Affiliated club shows cause, which in the
opinion of the Association is sufficient, why any greens required by
the Association under Clause (a) should not be made available, the
Association shall withdraw its requirement.
(c) If a Club
withdraws its greens from the Association competition without
sufficient cause, the greens shall not be available on the same day for
any other event. A penalty may be imposed under Article 41.
22. DUTIES OF OFFICERS
(a)
The President shall preside at all meetings of the Association other
than meeting of such committees and be responsible for the proper
conduct of such meetings. He shall be responsible for the enforcing of
all articles of this Constitution, By-Laws and Standing orders. In his
absence the Senior Vice President shall preside. Should the Senior
Vice President be also absent, any Vice President may be elected to
preside. The President shall be an ex-officio member of all Sub
Committees. The President shall have only one President’s Day in any
three year term.
(b) The Zone Representative shall;
(i) attend and represent the Association at meetings of the Board of the RNSWBA.
(ii)
prepare and submit reports on his activities as Zone Representative to
each meeting of the Management Committee and otherwise as required by
that Committee.
(c) The Association Secretary shall keep a
faithful record of all business transacted at all Committee and
Executive Committee Meetings and at Annual and Special Meetings. He
shall keep a record of the names and addresses of all Officers and
Delegates to the RNSWBA. He shall call all meetings and see that the
minutes of all meetings are properly entered in the minute book. He
shall record all District/Zone Championship Finalists/Runners-Up and
Pennant Finalists/Runners-up, and prepare the Annual Report for the
Bowling Season for presentation to the Annual General Meeting. He
shall keep a record of all property of the Association. He shall
receive and attend to all correspondence in connections with the
business of the Association. He shall collect all monies due to the
Association and pay it to the Hon. Treasurer for banking. Should the
Secretary be absent, neglect or refuse to act in accordance with this
Constitution, or if an Assistant is required, the Executive Committee
shall have the power to exercise all powers and duties of the Secretary.
(d)
The Hon. Treasurer shall be responsible for the payment of all monies
on behalf of the Association. He shall receive all monies due to the
Association from the Association Secretary and shall pay such monies
into an account in the name of the Association at such Bank or
Financial Institution as may be determined by the Executive Committee.
All
payments shall be made by cheque signed by any two of President,
Secretary and Treasurer. He shall furnish properly audited Account, an
Income and Expenditure Statement and Balance Sheet to accompany the
Annual Reports. He shall supply to the Management Committee at its
bi-monthly meetings a Statement of Receipts and Payments since the last
meeting.
23, LEAVE OF ABSENCE
The Management
Committee may, on written application grant leave of absence to any
member of the Committee for a period not exceeding 120 days or until
the next Annual Meeting if such meeting occurs prior to the completion
of the 120 day period. In the case of Delegate his position may be
filled by an alternate Delegate appointed by his Club during his period
of absence. Any member of any Committee who without having obtained
leave of absence is absent from three consecutive meetings of either
the Management Committee, Executive Committee and Sub Committees, his
position shall be declared vacant or such vacancy shall be decided by
an Executive Committee Meeting and if filled will hold that position
until the next Annual General Meeting of the Association.
24. VACANCIES
(a)
Subject to the provisions of Section (10) and Section (31) of this
Constitution, the Executive may by appointment, fill any casual vacancy
occurring amongst its members. In the case of the Office of President
becoming vacant during the year, the Senior Vice President or a Vice
President by ballot, shall act as President until the next Annual
Meeting.
(b) Any Member who has been suspended or expelled from
an Affiliated Club, or Provisionally Affiliated Club and holds office
on the Management Committee shall be ineligible to hold office and
attend meetings of the Association for the duration of his suspension
or expulsion.
25. DELEGATES
(a) Every Affiliated
and provisionally affiliated Club shall be entitled to have two (2)
Delegates, who must be full financial Members of the Club, attend every
Meeting of the Management Committee of the Association.
(b)
Every affiliated and provisionally affiliated Club shall notify the
Association Secretary in writing on or before 31st August each year or
within fourteen (14) days of the date of their Annual Meeting, if such
meeting is held after 31st August in that year, the names, postal
address and telephone number, if any, of each Delegate.
(c)
Should any appointed Delegate fail to attend three (3) consecutive
Meetings, without leave of absence or being represented by an alternate
Delegate, his seat shall become vacant and his Club shall be notified
and requested to replace that Delegate. Any defaulting Delegate shall
not be eligible to be appointed to any position on the Management
Committee during the next three complete years. Each Delegate will
receive an admittance card to be presented at each meeting.
26. ALTERNATIVE DELEGATE
In
the event of a Club Delegate being unable to attend any Meeting of the
Management Committee, his home Club may appoint any Full Member to act
as an alternative and speak at such Meetings. Such alternative
Delegate shall produce to the Association Secretary prior to taking his
place at the Meeting, the Authority from the Home Club to act.
27. FUNDS
(a)
The funds of the Association shall be placed in a Bank or Financial
Institution and dealt with as provided for by Section 27 (b) of this
Constitution.
(b) The Executive Committee shall have power to
deal with monies of the Association not immediately required upon such
securities and in such a manner as may from time to time be decided on
by that Committee.
(c) All “out of pocket expenses” incurred
shall be paid after having been documented and presented and approved
by the President.
28. AUDIT
The Statement of
Accounts and Statement of Income and Expenditure and Balance Sheet for
the period of twelve (12) months ending the 30th June each year, duly
certified as correct by the Auditors shall be submitted to the Annual
Meeting of the Association.
29. TRUSTEES
The
Trustees of the Association shall be the President, Association
Secretary and Hon. Treasurer for the time being of the Association.
30. BY-LAWS AND STANDING ORDERS
The
Management Committee shall have the power to make and enforce this
Constitution and Standing Orders and By-Laws, providing that such
Standing Orders and/or By-Laws are not inconsistent with the
Constitution of the RNSWBA.
31. COMMITTEES
(1) PERMANENT SUB COMMITTEES
The
Management Committee shall elect Permanent Sub Committees, provided
that no Club shall have more than two of its members on any one Sub
Committee. The Association Secretary shall have ballot papers printed
with the names of the nominees of each Sub Committee should there be
more nominations than the number of Members required for each
Committee. The position on the ballot paper shall be determined by the
Association Secretary. No member shall be on more than one Sub
Committee at any one time. The Chairman of each Sub Committee shall
submit a written report at each Meeting of the Management Committee.
Every Member of the Sub Committees, subject to the provisions of
Article 10 of this Constitution shall hold office until his successor
is appointed. The provisions of Article 10 shall apply to Members of
Sub Committees. The following Permanent Sub Committees shall be
elected at the Annual Meeting held in the month of August each year.
(a)
The MATCH COMMITTEE of seven (7) members who shall elect their own
Chairman and shall have one representative to the Association who shall
be entitled to one vote at the Management Committee Meetings.
(b)
The SELECTION COMMITTEE of five (5) members who shall elect their own
Chairman and shall have one representative to the Association who shall
be entitled to one vote at the Management Committee Meetings.
(2) OTHER SUB COMMITTEES
(a)
The COACHING COMMITTEE shall consist of a Chairman and four (4)
members recommended to the Executive for appointment by the coaches.
One whom shall be holder of a Coaching Accreditation Scheme Certificate
and shall have one representative to the Association who shall be
entitled to one vote at the Management Committee Meetings.
(b)
The UMPIRES PANEL shall consist of a Chairman and four (4) members who
shall be recommended by the Umpires Panel who shall be holders of a
National Umpires Certificate and shall have one representative to the
Association who shall be entitled to one vote at the Management
Committee Meetings.
(c) The JUNIOR COMMITTEE shall consist of
a Chairman and at least three (3) members who shall be recommended by
the Junior committee and shall have one MALE representative to the
Association.
(3) MANAGEMENT COMMITTEE
The
MANAGEMENT COMMITTEE may appoint from time to time an additional Sub
Committee for some specific purpose. Each Permanent Sub Committee
shall appoint a minute secretary to keep minutes of all meetings. Such
minutes shall be supplied to the Association Secretary for filing with
the Association records immediately after meetings.
32. DUTIES OF PERMANENT COMMITTEES
(1) MATCH
(a) Prepare the ensuing season’s program of Association events and
circulate same; allocate venues of play in respect of Association
competitions; process nominations for events; prepare and circulate the
draws for play in each event; maintain records and publish results in
respect of each competition.
(b) To deal with all
applications for bowling events from Association Clubs and present to
the Management Committee in January of each year a program for the
ensuing year.
(c) To settle all disputes arising from
Pennants and other Association competitions. There shall be a right of
appeal to the State Match Committee against any decision of the
Association Match Committee in writing through the Association
Secretary.
(d) The Committee shall have the power to accept, reject or regrade any entry in any competition.
(e) The Match Committee acts under the authority of the RNSWBA.
(f) The Committee shall have the power to impose any or all of the penalties provided under the By-Laws.
(g) They shall be responsible to inspect Greens before the commencement of the Pennant Competition and Championships and report the results of such inspections to the Association Secretary, their condition or otherwise for Pennant and other competitions.
(h) At the request of the Association Secretary, inspect and report on the condition or otherwise of Greens prior to the date of Inter Association or other Association events.
(i) After each inspection, a written report should be furnished to the Association Secretary, setting out the particulars of such inspection.
(2) SELECTION
(a) The Selection Committee shall select all teams to play in all Inter-Association matches.
(b) To report immediately, such selections to the Association Secretary.
(c) To appoint from amongst its members a NON PLAYING Side Manager who
will report in writing all results of matches as soon as possible to
the Chairman of the Match Committee. Appoint a score board attendant
(not necessarily a selector) for each Association Match.

33. BOWLING YEAR
(a) The bowling year shall commence on 1st January each year and extend to the 31st December of the same year.
(b) All Club and Association Championships shall commence and end in the same year.
34. CHAMPIONSHIPS AND OTHER ASSOCIATION COMPETITIIONS
(a)
The Greens of all affiliated Clubs shall be made available to the
Association for the playing of any competition or match arranged or
under the control of the Association.
(b) The Association
will conduct annually Pennants, Championships in Singles, Pairs,
Triples and Fours and Champion of Champions events.
(c) The Association may arrange from time to time any other competitions as may be
directed by the Management Committee.
(d)
All competitions shall be conducted under W.B.B. Rules and By-Laws of
the RNSWBA and the Laws of the Game as fixed from time to time by BA.
(e) Nomination fees shall be fixed by the Management Committee for each competition.
(f)
All Association Fixtures take precedence over Club Fixtures, except
for trial matches conducted for and on behalf of the Reserve Squad.
(g)
No Member or disqualified Member of an affiliated Club shall play in
any Association Match or Competition during the season for more than
one Club without the written permission from the Match Committee. Such
permission shall not be issued unless the said Member shall have first
resigned full membership of the Club for which he has declared to play
for the season.
For the purpose of this Article the Major
Singles, Major Pairs, Major Triples and Major Fours of a Club shall be
deemed to be Association competitions.
35. ATTIRE
In
all Association competitions, players shall appear in correct attire as
prescribed by the Association. In all RNSWBA competitions, i.e. Club
Championships, State Championships and Pennants, players shall comply
with the provisions of RNSWBA By-Law 10.
Non compliance with this Article may render the Club or players as the case may be, liable for disqualification.
36. MULTIPLE MEMBERSHIP
(a)
Any member of two Clubs shall only play in any Association Competition
for one Club during the same bowling year, unless he obtains written
permission from the Match Committee subject to Article 34 (g) of this
Constitution.
(b) He shall be deemed to have declared his
Club for the bowling year as the Club for which he first plays in any
Association Competition.
37. BOWLING EVENTS
(a) No Club shall conduct any bowling event in which Members of other
Clubs are invited to compete without first obtaining the permission of
the Management Committee. Such permission to be applied for in writing
to the Association Secretary, setting out the particulars of the
proposed event, sponsors and the value of prize money or trophies to be
awarded.
(b) Any Club wishing to conduct a bowling event to
be included in the State Ranking System where an invitation is made to
outside bowlers, that Club must first obtain the approval of the
Executive (through the Association Secretary) to conduct such event.
38. INELIGIBLE PLAYERS
(a) A Club permitting any Member to play in any Association Competition
without first duly entering his name with the Association for
Registration as a Member of such Club, shall forfeit all matches in
which that Member took part and shall be liable to a fine of such
amount determined by the Association from time to time.
(b) Where a Member of a Bowling Club, affiliated with this Association,
has been suspended or expelled from a Club or Association, he shall
not, during the period of such suspension or expulsion, be permitted to
play in any Association fixture and will be deemed to be ineligible
Member.
39. DISPUTES AND OBJECTIONS
(a) The
Executive Committee shall have the power to settle all disputes on any
matter relating to bowling, either between affiliated or provisionally
affiliated Clubs or between Members thereof which may be submitted to
it by the Secretary of any affiliated or provisionally affiliated Club
and any decision shall be reported to the Management Committee.
(b)Any decision of the Executive or Management Committee with relation to
Article 34 (g) shall be final in this Association, however an appeal
may be lodged by the individual to the RNSWBA within fourteen (14) days
of the individual concerned being notified by the Executive Committee
of its decision.
(c) No affiliated Club or provisionally
affiliated Club or its members shall make direct representation to the
RNSWBA without first notifying the Association Secretary in writing of
their intention.
40. INTER ASSOCIATION MATCHES
Any
player selected to play in any Association Match cannot withdraw and
play in any other event on the same day. Disqualification may be
imposed by the Management Committee for up to six (6) Inter Association
Matches for no justifiable cause shown without first being called
before the Executive Committee, fourteen (14) days notice in writing,
signed by the Association Secretary, such notice to be forwarded by
certified mail to the Members last known address.
41. SUSPENSION OF A CLUB OR PROVISIONAL CLUB
The
Association may suspend or cancel the affiliation of any Club or
Provisional Club which shall infringe any Rule or against which any
complaint in writing shall have been lodged with the Association
Secretary or which shall knowingly permit conduct amongst its members
which, in the opinion of the Association, shall render it unfit to
retain its affiliation. The Association may, in lieu of suspension or
cancelling the affiliation of any Club reprimand it.
Provided
that no Club shall be reprimanded or have its affiliation suspended or
cancelled without being supplied with notice of infringement or
complaint against it. The notice shall be signed by the Association
Secretary and shall be dispatched by certified mail addressed to the
Secretary of the Club against which such complaint has been made at
least twenty one (21) days before the Meeting of the Association at
which any such complaint is to be dealt with unless notice to appear to
show cause why they should not be suspended or cancelled. The
Affiliation of any such Club shall not be suspended or cancelled nor
shall be reprimanded unless on a vote of a majority of at least
two-thirds of the Management Committee present and voting.
42. INDEMNITY
The
Members of the Executive of the Association, the Management Committee,
Honorary Solicitor, Publicity Officer and any members of any Committee
of the Association, duly appointed, acting in relation to any affairs
of the Association and every of them and every of their Executors and
Administrators shall be indemnified and held harmless by the
Association against all actions, cost, charges, losses, claims,
demands, damages and expenses, which they or any of them or any of them
their or any of their Executors and Administrators shall or may incur
or sustain by or by reason of any act done, occurred in omitted in or
about the execution of duty or supposed duty of their respective
offices, except such (if any) as he or they shall incur or sustain by
or through his or their own wilful neglect of default respectively and
none of them shall be answerable for the acts or defaults of the other
or others of them, or for any loss, misfortune or damage which may
happen in the execution of their respective offices, or in relation
thereto, except the same shall happen by or through his or their wilful
neglect of default respectively.
43. WINDING UP
(a)
The assets and income of the Association shall be applied solely in
furtherance of its objects and no portion shall be distributed
directly or indirectly to its members as bona fide compensation for
services rendered or expenses incurred on behalf of the Association.
(b)
In the event of winding-up or dissolution the net assets of the
Association shall be handed over to some other organisation or
organisations having objects similar or in part similar to the objects
of the Association and which shall also prohibit the distribution of
its or their property among its or their members such organisation or
organisations be determined by the members at or before the time of
dissolution or in default thereof by the Chief Judge of such Court as
may have or acquire jurisdiction in the matter.
44. CONSTITUTION
(a) The Constitution adopted 17th day of May 1990 is hereby repealed.
(b) All motions passed under the Constitution are hereby repealed if in force at the commencement of this Constitution.
(c)
All present Officers and Members of the Executive Committee,
Management Committee and Delegates shall deem to have been fully
elected in accordance with this Constitution.
(d) This Constitution will become operative on 18th January 1996.
(e) All amendments in this Constitution to show the dates when passed by the Management Committee.
(f)
This Constitution shall only be amended in the months of January and
August (AGM) or at a Special Meeting called for under Article 7 (b) of
this Constitution.
STANDING ORDERS
1. The movers of motions are limited to five minutes speaking time and
all other speakers, including the right of reply are limited to five
minutes, provided that such limits may be extended by the Chairman with
the consent of the Meeting.
2. When a motion or amendment has been
moved and seconded, no further speech in support shall be heard unless
someone has spoken in opposition, then speakers for and against should
be taken in rotation. Once the mover of a motion has exercised his
right of reply, the debate is closed and the vote should be taken. An
amendment should be put first and if carried becomes the motion. Then
should be debated any further amendments which have been
foreshadowed.
3. A speaker is allowed to speak only once to each
question. Every amendment moved shall be treated as a new question.
The mover only of an original motion shall have the right of reply.
4.
It shall not be permissible to withdraw any motion that has been put
from the Chair except with the consent of the Meeting. Once
dissentient voice being sufficient objection.
5. Where a motion to
alter or rescind a resolution has been defeated, no similar motion
shall be brought forward for six months thereafter. The effect of this
provision shall not be changed by substituting any motion differently
worded but in principle the same.
6. During the course of debate on
any question the following motions are only acceptable.
(a)
Permission to withdraw a motion or amendment.
(b) To go into
Committee.
(c) To adjourn debate on the question.
(d) The question to be put forthwith.
(e) To postpone discussion for a given time.
These motions shall take precedence in the above order and shall be put without debate.
7.
Any motion or amendment may be withdrawn by the mover with the consent
of the seconder before it is debated. If it has been debated the
consent of the meeting shall be required.
8. A speaker exercising his right of replay shall not introduce new matter.
9. No matter may be re-committed unless upon a two-thirds majority of the members present at the Meeting.
10.
A resolution passed at any Meeting may not be rescinded at the same
Meeting unless a two-thirds majority of those present at the Meeting
voting in favour of such rescission. Nor at any subsequent Meeting
unless notice of such intended rescission has been given in the same
manner as a Notice of Motion.
11. Unless otherwise provided
any question at any Meeting shall be determined by a simple majority of
votes of Members present.
